Released in 2021 with a glamorous promotion featuring LeBron James, "MTN DEW RISE ENERGY" is a new energy drink series under the Mountain Dew brand.
To attract a new audience that had not previously consumed energy drinks, six flavors were launched simultaneously.
The caffeine content is slightly higher than usual, at 180mg, and it is a low-calorie option with almost no sugar, containing only 25kcal. This marked the beginning of an energy drink brand separate from the sugary, unhealthy energy drinks of the past.
Trademark Lawsuit After Launch – "RISE" Couldn't Be Used
Soon after launch, the brand was hit with a trademark lawsuit from RISE Brewing, a company selling coffee products.
Despite differences in size, design, beverage category, and logo, RISE Brewing claimed that "MTN DEW RISE ENERGY" infringed on their trademark.
Looking at the RISE coffee packaging, it's hard to see how "MTN DEW RISE ENERGY" could negatively affect them...
A local court ruled that both "RISE" and "MTN DEW RISE ENERGY" were "significantly similar," issuing a temporary injunction in November. As a result, the packaging was changed to "MTN DEW ENERGY," dropping the "RISE."
It was hard to understand why this lawsuit was even recognized, given the clear differences between the two brands.
MTN DEW ENERGY Wins in the Second Trial
In the second trial in 2022, "MTN DEW ENERGY" won.
The summary was:
- The word "RISE" had been used over 100 times in relation to coffee, tea, bottled beverages, energy drinks, soft drinks, and other products.
- The logo and packaging design were not confusingly similar to RISE Brewing products.
The temporary injunction was lifted, and "RISE ENERGY" could be used again.
This was obviously the right decision, and it allowed the brand to return to its original "MTN DEW RISE ENERGY." However, over a year had passed since the rebranding, so changing the brand name again seemed a bit awkward.
In 2023, the brand name remained "MTN DEW ENERGY," and limited-edition flavors were released, maintaining the "MTN DEW ENERGY" brand.
2024, The End of MTN DEW ENERGY
In 2024, after the release of MTN DEW ENERGY Baja Blast, a press release announced that the MTN DEW ENERGY series would be discontinued. The brand lasted just three years.
With fitness supplement brands expanding into the energy drink market from around 2020 and gradually increasing their market share, it is likely that MTN DEW ENERGY’s sales were not favorable.
In fact, in 2023, MTN DEW ENERGY was barely seen on store shelves. The stores that carried it were few, and even if you wanted to buy it, it wasn’t available. By that point, MTN DEW ENERGY was clearly heading towards its end.
Since PepsiCo already owns Rockstar, they probably saw no need to keep pushing MTN DEW ENERGY.
